1. Acceptance of Terms
By accessing our website or using any of our services (the “Service”), including SMS or other messaging communications, you agree to these Terms of Service (“Terms”). If you do not agree, please do not use our services.
2. Messaging Program Description
St. Thomas Charters uses SMS messaging to communicate with customers regarding charter bookings and related services. Messages may include, but are not limited to:

- Schedule updates, including weather-related changes
- Payment confirmations or reminders
- General service or account-related communication
- Occasional promotional or informational messages (only where consent has been given)
Message frequency varies depending on the nature of the interaction and user preferences. St. Thomas Charters does not send unsolicited text messages.
3. User Consent (Opt-In)
You may receive messages from us after you choose to interact with our business, such as by:

- Booking or requesting a trip
- Asking questions about availability, pricing, or services
Your consent to receive messages is not required to book a trip.
4. Message Frequency
Message frequency will vary. Message and data rates may apply. You may receive up to 10 promotional messages per month, along with additional messages related to your booking or trip.
5. Opt-Out & Support
You can opt out of SMS messages at any time by replying STOP to any message. After doing so, you may receive one final message confirming your request.

6. Fees & Charges
Standard message and data rates may apply based on your mobile carrier and plan. St. Thomas Charters is not responsible for any charges related to message delivery.
7. Supported Carriers
Our messaging service is supported by most major U.S. carriers, but delivery is not guaranteed. Carriers are not responsible for delayed or undelivered messages.
8. Prohibited Use
You agree not to misuse our messaging service. This includes:

- Sending spam or unsolicited messages
- Fraud, impersonation, or deceptive practices
- Sharing inappropriate or unlawful content
- Violating any applicable laws or carrier regulations
We reserve the right to suspend or terminate messaging access for any violations.
9. Age Requirement and Parental Consent
Our services are intended for individuals 18 years of age or older. Anyone under 18 must be accompanied by a parent or legal guardian. All bookings must be made by an adult who is legally responsible for the reservation.
10. Privacy & Data Use
Your personal information, including your phone number, is handled in accordance with our Privacy Policy.
We do not sell or share your information with third parties for their marketing purposes.
11. Service Modifications & Termination
We reserve the right to modify, suspend, or discontinue any part of our messaging services at any time without notice. We may also revoke access if these Terms are not followed.
12. Cancellation & Weather Policy
We understand that plans can change, and safety on the water always comes first.

- Cancellations by Customer:
Cancellations made at least 48 hours before your scheduled trip may be eligible for a refund or rescheduling, depending on availability. Cancellations made within 48 hours of the trip may result in a partial refund or forfeiture of the deposit. - No-Shows:
Failure to arrive at the scheduled departure time will be treated as a no-show and is non-refundable. - Weather Conditions:
The captain reserves the sole right to determine whether conditions are safe to operate. If a trip is canceled due to unsafe weather or mechanical issues, you will be offered the option to reschedule or receive a refund. - Early Termination of Trip:
If a trip is cut short due to weather or unforeseen circumstances, partial refunds or credits may be offered at the captain’s discretion.

13. Disclaimer & Limitation of Liability
Our messaging services and charter operations are provided “as is.” We are not responsible for delays, cancellations, or interruptions caused by weather, mechanical issues, or other factors beyond our control. Participation in boating activities involves inherent risks, and by booking with us, you accept those risks.
